Boston Nursing Home Abuse Lawyers

Our elderly family members deserve to be treated with respect and care. Those that reside in nursing homes and assisted living facilities because of their advanced age or medical or mental health issues are dependent upon on nurses, aides, and staff members to provide them with quality and compassionate care and to protect them from harm. Unfortunately, nursing homes are often understaffed, and our elderly or disabled parents, grandparents, and other family members are too often victimized by neglect and staff negligence, as well as instances of shocking physical, sexual, and financial abuse.

Nursing homes are governed by strict rules and regulationsi-nursinghomeabuse

Federal regulations provide that the “resident has the right to be free from verbal, sexual, physical, and mental abuse, corporal punishment, and involuntary seclusion.” Nursing homes must develop and implement written policies and procedures that prohibit mistreatment, neglect, and abuse of residents. The federal regulations further require that nursing homes “promote care for its residents in a manner and in an environment that promotes maintenance or enhancement of each resident’s dignity and respect in full recognition of his or her individuality.”

Despite these regulations, many elderly patients suffer abuse in nursing homes. We represent nursing home residents in a wide variety of situations, including those involving:

  • Medication errors
  • Failure to prevent falls
  • Failure to respond to calls for emergency assistance
  • Bedsores and pressure ulcers
  • Bacterial infections or sepsis
  • Malnutrition or dehydration
  • Physical, verbal, or sexual abuse

Nursing home abuse can lead to serious injuries and emotional distress

The victims of nursing home negligence are frequently those who are weak, very ill, or otherwise incapable of defending themselves. When nursing home administrators and staff members abuse or neglect residents, the people we love can suffer serious illnesses, injuries, emotional distress, and even death.

Falls are a particular problem in nursing homes. Falls are the most frequent cause of broken bones among the elderly, and hip fractures are the most common injury. Hip fractures frequently require surgical intervention, have a long recovery period, and can result in long-term disability. Nursing homes have an ongoing duty to assess a resident’s risk of falling. For residents who are at risk of falling, nursing homes must have a strategy for preventing falls and minimizing the risk of harm in the event that an unavoidable fall should occur.
