Investigations
Title VI of the Civil Rights Act of 1964 prohibits discrimination on the basis of race, color, or national origin in programs and activities that receive Federal Financial Assistance (FFA). This means that any organization that receives federal funding cannot discriminate against individuals based on their race, color, or national origin. Title VI applies to a wide range of programs and activities, including education, healthcare, transportation, and housing.

What is a Title VI investigation?
A Title VI investigation involves a formal process in which a complaint alleging discrimination based on race, color, or national origin in a program receiving federal funding is filed, reviewed, and investigated by an investigator who gathers evidence through interviews and document review.

Who do you represent?
Attorney Sankey does not represent the school district or any of the parties. He acts solely as a neutral and impartial fact-finder. He gathers evidence from parties and witnesses and then determines whether a violation of Title VI has occurred.

What is the process in a Title VI investigation?
A Title VI investigation typically involves the following processes:

Initial assessment: The Title VI investigator reviews the complaint and determines how to proceed.

Notify parties: The investigator will contact the involved parties of a formal Title VI investigation.

Gather evidence: The investigator will interview the complainant, the respondent, and all witnesses. Evidence may include photos, videos, phone records, and social media information.

Analyze evidence: The investigator will review and analyze all evidence.

Determine if there was a violation: The investigator will then determine, through the evidence, if a violation occurred.

Write a report: The investigator then writes a report of his findings.

Notify parties of outcome: The involved parties are then notified of the outcome of the investigation by the school district.

How is a Title VI complaint resolved?
Based upon the investigation, a determination is made regarding whether a violation occurred. If a violation is found, the school district will take corrective action as appropriate.
